Contract term

Fifty (50) years from the earlier of (i) twelve (12) months after the Effective Date or (ii) Substantial Completion, with an option for a successive term of up to fifty (50) years upon mutual agreement, and coterminous with the Franchise Agreement

Renewal

Initial term is 50 years from the earlier of twelve months after the Effective Date or Substantial Completion, with a possible Extension Term of up to an additional 50 years if the Franchise Agreement is extended and both parties mutually agree and Developer is not in default. The Agreement automatically terminates earlier if the underlying Franchise Agreement expires or is terminated, with certain easement and indemnification provisions surviving.
