Owner’s Construction Budget is $400,000.00; Design Phase Fee not to exceed $3,877.00; Construction Phase Fee $59,387.00; Overhead and Profit 8% of Direct Cost Items plus General Conditions and Owner Direct Purchase items; 100% Performance Bond and 100% Labor and Material Payment Bond in amount not less than total Cost of the Project plus Construction Manager’s fees

CONSTRUCTION

Agreement dated May 11, 2026; Construction Phase Fee paid in four (4) monthly payments beginning 30 days after first Construction Authorization; additional $500.00 per working day Construction Phase Fee if construction extends one month beyond scheduled Final Completion (when delay is not CM’s fault); 1-year warranty from Owner Occupancy and 1-year warranty from Final Completion for all work and materials; records retention four (4) years after final payment

No automatic renewals; GMP and scope changes to be established and modified by written amendments and change orders. Construction Phase Fee may increase for schedule extensions not caused by the CM ($500 per working day) and for GMP increases exceeding $100,000, with 8% additional overhead and profit on the excess. Warranty period is one (1) year from Owner Occupancy and one (1) year from Final Completion, with a required nine‑month warranty inspection.
