Renewal

The agreement has a 10-year term from the commercial Operation Date. The City Manager may extend the term for seven additional years if the owner is not in default and remains in compliance; the parties may also extend the agreement by mutual consent and formal amendment. Term extensions are also available for specified third-party delays, litigation, governmental actions, or force majeure events.
