Original coverage with a 40% reduction was granted in 2020; as of December 11, 2025, the Board eliminated the reduction under Policy Resolution 2012-06 after approval of a Compliance Plan and Schedule and an approved corrective action plan. If Canyon Plaza fails to comply with the plan and schedule, NDEP staff must reinstate the 40% reduction, and the operator would not be eligible for further reconsideration.
