Description

The City of Glendale entered into a five-year Wired Telecommunications License and Right-of-Way Use Agreement with Summit Infrastructure Group, LLC to allow installation, operation, and maintenance of fiber optic telecommunications facilities in city rights-of-way. Summit will pay application, permit, transaction privilege, and route-based usage fees, maintain a performance bond and security fund, carry substantial insurance, and comply with strict construction, mapping, relocation, and safety requirements. The nonexclusive license may be renewed under then-current laws and fee schedules and allows potential future in-kind fiber or conduit contributions as fee offsets by addendum.

Original term runs for five years from City Council approval, expiring at 11:59 p.m. the day before the fifth anniversary; Summit must apply for a new license at least 180 days before expiration under then-current laws and pay the applicable application fee. Upon renewal or extension, the City may renegotiate any prior terms and apply future code and fee schedule changes; if facilities remain and annual fees are paid, a holdover term of up to 60 days may apply, during which no new permits will be issued. Failure to secure a new license by the end of the holdover may result in immediate withdrawal and revocation of existing permits, though the City may exercise discretion if a timely application is under active negotiation.
