Effective as of _________, 2026, and remaining in effect through the later of the useful life of the Project (not less than 20 years from Project Completion) and expiration of the District’s flowed-down Grant Agreement obligations

Agreement term extends through at least the Project’s useful life (not less than 20 years from Project Completion) and the duration of OPUD’s flowed-down obligations under Grant Agreement No. D2505004; any amendment or termination requires prior written consent of the State Water Resources Control Board. OPUD may suspend or terminate if required project funding fails to materialize, subject to State Water Board consent.
