East St Louis SD 189 Awards Technology Contract to Voltus Inc (July 2026)

$45,000.00 per MW per year for Program periods 2026-27, 2027-28, and 2028-29; Energy Payments percentage as set forth in Exhibit 1; Voltus Technology fee $0 per Facility per month

TECHNOLOGY

Initial term of 72 months after the first day of participation in the Programs, with automatic renewals for equal subsequent terms unless terminated with 90 days’ notice before term end

Agreement starts on the Effective Date and automatically renews 72 months after the first day of participation in the Programs for equal subsequent terms, unless either party gives notice of intent to terminate within 90 days of the end of the then-current term. Subsequent Program years’ fixed payment rates will be offered by Voltus in writing, after which the Customer may elect either the fixed rate or 51% of the MISO auction clearing price for that year.
