FINANCIAL_SERVICES

Effective upon last signature in 2026; initial Phase 1 construction target by December 31, 2031 with option to extend one year; initial 10-year Abatement Period per Phase beginning January 1 following Certificate delivery (no later than for Phases with Certificates submitted by December 31, 2039); potential second 10-year abatement per Phase for qualifying expansion/modernization; overall Agreement continues through January 31 of the calendar year following the final year of abatement for the final Phase

Agreement allows a second 10-year abatement period per Phase for qualifying expansion or modernization under Section 9, with 75% abatement on Improvements and 100% on Business Personal Property, triggered by a Certificate submitted within 24 months after the first Abatement Period ends. No abatement period may exceed 10 years per phase or apply to any improvement or business personal property for more than 10 years at a time; subsequent abatements require qualifying expansion/modernization and Certificates. The overall Agreement may be amended by mutual written consent pursuant to Texas Tax Code Chapter 312.
