CONSTRUCTION

Two-phase agreement: Pre-Construction Phase through GMP establishment (within 45 days after completion/approval of Construction Documents); Construction Phase term to be set in future GMP Amendment including Contract Time and Substantial Completion date

This is a two-phase CM-at-Risk agreement, with pre-construction services in Phase I and construction services in Phase II to be authorized via a GMP Amendment once a mutually agreed Guaranteed Maximum Price and Contract Time are established. The contract allows for future amendments, change orders, and construction change directives but does not describe automatic renewals; the owner may terminate if GMP negotiations fail, in which case only pre-construction compensation is owed.
