Initial five-year term from January 1, 2027 through December 31, 2031, intended to be co-terminous with a five-year Special Use Permit, with the stated intent to continue this or a similar agreement as long as the Facility operates with NYSDEC-permitted capacity. If not renewed, the HCA may continue month-to-month with Town Board written consent until a new agreement is executed. Agreement may be amended by mutual consent and terminates earlier if NYSDEC-permitted disposal capacity ceases or WMNY is no longer authorized to operate.
